Please read these Terms and Conditions (the "Terms" or "Terms and Conditions") carefully before using this site (the “Website”) and the GoRemitHK mobile application (the "Application") operated by GoRemitHK (the GoRemitHK, "us", "we", or "our"). These Terms describe the terms pursuant to which we offer you (the “User”) access to both of the Website and Application (together referred to as “Services”). These Terms and Conditions apply to all visitors, users and others who access or use this website or download, install, access and use the Application.

Acceptance of the Terms and Conditions

These Terms and Conditions and our Privacy Policy contain the entire agreement (the “Agreement”) between you and GoRemitHK. The access to our Services is conditioned on your acceptance of and compliance with these Terms. When using the Services, you shall be subject to any posted guidelines or rules applicable to such services, which may be posted and modified from time to time. All such guidelines or rules are hereby incorporated by reference into the Terms. Any rights not expressly granted herein are reserved. By registering on and using any of the functions provided by the GoRemitHK Website or Application, you are deemed to have read, understood and accepted all of the following Terms and Conditions. You agree to abide by the Terms as well as any applicable laws, rules and regulations. You understand that it is a breach of this Terms and Conditions to use the Services to conduct a transaction in connection with illegal activities such as money-laundering, fraud and funding of terrorist organisations. In the event that you use the Services to conduct illicit business, we reserve the right to report the matter to the appropriate legal authorities in compliance with our statutory obligations. If you disagree with the Terms, do not provide any materials to us, download any materials from us or use GoRemitHK.

Amendments

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Any material changes to these Terms on the Services will be provided with a thirty (30) days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. If you disagree to the new terms, you may contact us at support@goremit.hk within the applicable thirty (30) days period for account termination or other actions. Otherwise, the new terms will take effect after thirty (30) days.

Privacy Policy

When using GoRemitHK, please review the GoRemitHK Privacy Policy in order to understand how your information are being collected and used when you use, access, download, or install the Services. The GoRemitHK Privacy Policy is part of and is governed by these Terms and Conditions. By accepting the Terms, you agree to be bound by the terms of the GoRemitHK Privacy Policy, and agree that we may use the collected information from you in accordance with the GoRemitHK Privacy Policy.

Accounts and Registration

In order to be eligible to use GoRemitHK, you have to create an account by completing the registration processes and get verified by us. You can access the website without logging in, but you will not be able to proceed to some of the main features unless you do so. You can login to GoRemitHK through the Services once your account is being verified. By creating a GoRemitHK account you represent that you are:

(i) at least eighteen (18) years old and have the full capacity to accept these Terms and enter into a transaction as a result of using the GoRemitHK platform;

(ii) of legal age to form a binding contract;

(iii) confirming the details provided upon registration are true, accurate, and current as well as promptly update your personal or business entity information as and when it changes;

(iv) agreeing on only to trade with legally obtained funds that belong to you;

(v) agreeing on taking full responsibility for your actions and any gains or losses sustained as a result of using the GoRemitHK platform;

(vi) not barred from using the Services under the laws of Hong Kong or another jurisdiction; and

(vii) not using the services for illegal activities such as money-laundering, fraud and funding of terrorist organisations.

Account Termination

You may terminate your account at any time by contacting us at support@goremit.hk. After the termination you will still be able to access and view the Website and Application, but you will not have access to any of the customized features and content that are available to our registered users. We may also terminate your account, or impose limits on or restrict access to parts or all of the Services at any time, without notice or liability if breaching of Terms and Conditions or other policies occurs.

Links to Other Websites

These Terms and Conditions that apply to the use of GoRemitHK do not extend to any linked third party sites, including the content of and your activity on those websites. You should review third-party websites’ Terms of Use, privacy policies and all other website documents, and inform yourself of the regulations, policies and practices of third-party websites.

Supported Countries and Currencies

GoRemitHK supports multiple sending and receiving currencies. Before listing out the supported currencies, it is important to point out that currently GoRemitHK is accepting companies and individuals who are from countries that are part of the Financial Action Task Force (FATF). The objectives of the FATF are to set standards and promote effective implementation of legal, regulatory and operational measures for combating money laundering, terrorist financing and other related threats to the integrity of the international financial system. GoRemitHK reduces risks (ie: business risk, financial risk) by supporting currencies of FATF members while restricting high-risk and non-cooperative jurisdictionshigh-risk and non-cooperative jurisdictions territories to be involved. GoRemitHK is also running in reference to the international standards set by the Organisation for Economic Co-operation and Development (OECD).
GoRemitHK supporting currencies are as follow:

(i) the sending currencies;

HKD – Hong Kong Dollar

USD – United States Dollar

(ii) the receiving currencies;

CNY – Chinese Yuan

IDR – Indonesian Rupiah

HKD – Hong Kong Dollar

USD – United States Dollar

MYR – Malaysian Ringgit

SGD – Singapore Dollar

Each sending currency is converted to the desired receiving currency at the mid-market FX exchange rate with a minor mark-up spread for FX hedging and operation cost.

Ownership of the Services

Upon using GoRemitHK, you agree that its licensors or partners own all rights, title and interest in the Services and all materials provided in connection with the Services, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights or photographs, (the GoRemitHK Content”), and all intellectual property rights related to the GoRemitHK Content. You may not (and you may not allow any third party to) copy, modify, create a derivative work from, decompile, reverse engineer, reverse assemble or otherwise attempt to discover any source code of the Services. The GoRemitHK name, logo and symbols and related names are trademarks and service marks of GoRemitHK (the GoRemitHK Marks”). You agree not to display or otherwise use any GoRemitHK Marks without GoRemitHK prior written consent.

Disclaimer of Warranties

The GoRemitHK parties make no representations or warranties that the website, or any Services provided by the website will be uninterrupted, timely, secure, or error free. We do not warrant that the services or the servers that make the services available will be free of viruses or other harmful components. You expressly agree that your use of the services is at your sole risk. You will be responsible for any damage to your computer system or loss of data that results from using the services. We reserve the right to restrict or terminate your access to the services at any time. The GoRemitHK parties assume no responsibility for the deletion, delivery mistake or failure to store any content or personalized settings.

Limitation of Liability

By using GoRemitHK, you agree to the limitation of our liability. You agree that GoRemitHK, our directors, employees, service providers, or other users will not be liable for any direct, indirect, special, incidental, consequential, exemplary or punitive damages, including but not limited to damages for loss of use, loss of profits, loss of information, business interruption, goodwill, or other intangible losses of resulting from your use or access of, or inability to use the site, or mistakes, omissions, interruptions, deletions, errors, defects, viruses, delays in operation or transmission or any failure of performance of the site or any information transmitted to GoRemitHK.

Governing Law

GoRemitHK is licensed as a Money Services Operator (MSO) in Hong Kong. Hence, this Terms and Conditions and all its subsequent variations shall be subject to, governed by and interpreted in accordance with the domestic laws of Hong Kong SAR, without regard to its conflict of laws and principles.
